Employer’s Right to Interrupt or Postpone the Vacation

The employer has a right to interrupt or postpone a vacation only due to an unforeseeable and substantial work organizational emergency. The vacation can be interrupted primarily to avoid damage incipience.

Law obliges the employer to compensate costs emanating from vacation interruption or postponing to the employee. So, before interrupting the employee’s vacation, the employer should consider if they are willing to pay for the trip that the employee has bought but cannot go to due to the interruption, or is it simpler and cheaper to find another employee to fulfil the required work tasks. In this case, the employer could have to remunerate the substituting employee for overtime or additional work tasks.
