Standby Duty

Standby duty is the time when the employee is not obliged to carry out work tasks but must be prepared to start executing work tasks after receiving the corresponding order by the employer. The part of standby duty when the employee begins executing work tasks is treated as working time and the employer must pay the agreed remuneration to the employee for it. Standby duty can be implemented on mutual agreement between the employee and employer.

As the employee must be prepared to immediately start executing work tasks, the standby period must be compensated to the employee (at least 1/10 of the agreed remuneration). For example, if the employee usually earns 10 euros per hour, the employer must pay at least 1 euro for one standby hour.

When applying the standby duty, the daily and weekly resting time must be guaranteed to the employee. Even in the case of standby, the employee must get at least 11 consecutive hours of rest within 24 hours. For example, if the employee works 8 hours per day and the daily resting time is 30 minutes, this employee can have, at the maximum, 4 hours and 30 minutes of standby duty on the same day.
